1. The agreement
These Terms of Service ("Terms") are a binding agreement between you and the operator of Goodpicks, a sole trader based in Victoria, Australia ("Goodpicks", "we", "us"). By creating an account or using Goodpicks, you accept these Terms and our Privacy Policy. If you don't agree, don't use the service.
You must be at least 16 years old to use Goodpicks.
2. The service
Goodpicks lets you track recommendations — movies, TV shows, books, podcasts, videos, links and more — and optionally share them with friends. We offer a free plan with usage limits and a paid Pro subscription. We may change, add or remove features over time; if a change materially reduces what a paid plan includes, we'll give paid subscribers reasonable advance notice.
3. Your account
- Give us accurate information and keep your login credentials secure. You're responsible for activity that happens under your account until you tell us it's been compromised.
- One person per account. Don't share, sell or transfer your account.
- Usernames are first-come, first-served, but we may reclaim a username that infringes someone's rights, impersonates someone, or violates section 6.
4. Subscriptions and billing
- Paid subscriptions are sold and processed by Lemon Squeezy as merchant of record. Your purchase is also subject to Lemon Squeezy's terms. Lemon Squeezy handles payment collection and applicable taxes.
- Subscriptions renew automatically each billing period until cancelled. You can cancel at any time; your plan stays active until the end of the period you've paid for, and then downgrades to the free plan. Cancelling does not delete your account or content, though content over free-plan limits may become read-only.
- If we change subscription pricing, the new price applies from your next renewal after at least 30 days' notice.
- Refunds are handled reasonably and in accordance with the Australian Consumer Law and other applicable consumer laws. Nothing in these Terms limits your statutory refund rights.
5. Your content
You own what you save. We claim no ownership over your recommendations, notes, ratings or images. You grant us a limited, worldwide, royalty-free licence to host, store, display and transmit your content — only as needed to run the service and only according to the visibility you choose. Everything is private by default; content is shown to another user only when you set a recommendation's visibility to allow it or share it directly. The licence ends when you delete the content or your account, except for copies already shared with other users at your direction (for example, a cover image a friend added to their own list) and short-lived backups.
You're responsible for the content you save and share — including having the right to upload any image you attach.
6. Acceptable use
Don't use Goodpicks to:
- break the law or infringe anyone's rights;
- harass, abuse, impersonate or deceive other users — including via usernames, share messages or shared content;
- upload malicious, unlawful or infringing content, or content depicting the abuse of minors (zero tolerance — reported and removed);
- probe, overload, scrape or disrupt the service, circumvent rate limits or usage limits, or access another user's data;
- resell or white-label the service without our agreement.
We may remove content or suspend accounts that violate this section. Where reasonable, we'll warn you first.
7. Third-party content and services
Goodpicks displays metadata sourced from third-party catalogues (such as OMDb, Open Library and streaming-availability providers) — titles, cover art, ratings, streaming information. This data is provided for convenience and we don't guarantee its accuracy or availability. All movie, TV, book and podcast titles, artwork and trademarks belong to their respective owners; Goodpicks is not affiliated with or endorsed by them. Links to third-party sites are used at your own risk.
8. Availability
We aim to keep Goodpicks reliable but it's provided without an uptime guarantee. We may suspend the service for maintenance, security or events outside our control. If we ever decide to shut the service down, we'll give you at least 30 days' notice and a way to export your content.
9. Termination
- By you: stop using the service any time, and request account deletion as described in the Privacy Policy.
- By us: we may suspend or terminate your account if you materially breach these Terms, if required by law, or if your account has been inactive for over 24 months on the free plan (with email notice first). Except where prohibited by law or where urgent action is needed, we'll give you notice and a chance to export your content.
10. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded — including your rights to a refund, repair or replacement for a major failure. Sections 11 and 12 apply only to the extent permitted by law, and are subject to this section.
11. Disclaimer
Subject to section 10, Goodpicks is provided "as is" and "as available", without warranties of any kind beyond those that cannot be excluded. We don't warrant that the service will be uninterrupted, error-free or that data (including third-party metadata) will be accurate. You should not treat Goodpicks as your only copy of information you can't afford to lose.
12. Limitation of liability
Subject to section 10 and to the maximum extent permitted by law:
- our total aggregate liability to you for all claims arising out of or relating to the service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, and (b) AUD $50;
- we are not liable for indirect or consequential loss, loss of profits, loss of data, or loss of goodwill;
- where legislation implies a guarantee that cannot be excluded but liability for it can be limited, our liability is limited to resupplying the service or paying the cost of having it resupplied.
You agree to indemnify us against third-party claims arising from your content or your unlawful use of the service, except to the extent the claim was caused by us.
13. Changes to these Terms
We may update these Terms as the service or the law changes. The "last updated" date above always reflects the current version. For material changes we'll give at least 30 days' notice in the app or by email before they take effect; continued use after that means you accept the updated Terms. If you don't accept a change, stop using the service and (if you're a paid subscriber) you may cancel for a pro-rata refund of any unused period affected by the change.
14. General
These Terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Victoria — non-exclusive so that, if you're a consumer elsewhere, you keep any right to bring a claim in your local courts. If any part of these Terms is found unenforceable, the rest remains in force. These Terms and the Privacy Policy are the entire agreement between us about the service. We may assign this agreement as part of a sale of the service (see the Privacy Policy); you may not assign it.
